Welcome to aqua3dp.com (the “Website”), operated by aqua3dp (“we,” “us,” or “our”). By accessing or using our Website, purchasing our proprietary aquariums, or buying our custom-designed products, you agree to be bound by the following Terms of Service (“Terms”). Please read them carefully.

1. Age Restriction (18+)

  • Minimum Age Required: You must be at least 18 years of age to place an order or make a purchase on this Website.
  • Verification: By submitting an order, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If we discover or suspect that an order was placed by someone under 18, we reserve the right to cancel the order immediately without liability.

2. Proprietary Products & Manufacturing Characteristics

  • Intellectual Property & STL Ownership: All aquariums, components, and accessories sold on this Website are designed internally using our proprietary STL files and 3D digital designs. We retain full and exclusive intellectual property rights over these designs. Purchasing a physical product does not grant you any rights to replicate, copy, reverse-engineer, or digitally extract our designs.
  • Manufacturing Variations: Our products are manufactured utilizing advanced 3D fabrication processes. You acknowledge that minor surface variations, visible layer lines, and slight color differences are normal industry characteristics of 3D-designed manufacturing and do not constitute defects.
  • Product Usage: It is the customer’s responsibility to follow all setup, usage, and safety instructions provided with our aquariums to ensure structural integrity and the safety of aquatic life.

3. Pricing, Payments, & Order Cancellations

  • Pricing Accuracy: All prices are subject to change without notice. We reserve the right to refuse or cancel any orders placed for products listed at an incorrect price.
  • Order Processing: Because our proprietary aquariums and components are produced in-house, orders enter our production and logistics pipeline rapidly. Cancellations or modifications must be requested immediately and cannot be guaranteed once production or shipping preparation has commenced.

4. Strict No-Fraud, Chargeback, & Collection Agency Clause

  • Good Faith Resolution: If you have an issue with your order, billing, or shipping, you agree to contact our support team directly to resolve the dispute in good faith before contacting your bank or credit card issuer.
  • Unlawful Chargebacks: Initiating a chargeback or payment dispute for a legitimately delivered product, or an item currently in production and transit under these Terms, is considered a breach of contract and financial fraud.
  • Collection Agency Referral: In the event of an unjustified chargeback, we reserve the immediate right to report the debt to a professional third-party collection agency and major credit bureaus.
  • Recovery of Costs: If your account is sent to collections, you agree to be held responsible for the original order balance, plus an administrative recovery fee, collection agency fees, legal costs, and reasonable attorney fees incurred during the recovery process.

5. Limitation of Liability

  • Disclaimer: To the fullest extent permitted by law, aqua3dp provides its products “as is” without any express or implied warranties beyond standard manufacturing guarantees. We are not liable for any indirect, incidental, or consequential damages—including livestock or water damage—resulting from the use or misuse of our aquarium products.

6. Governing Law

  • These Terms and any dispute arising out of your use of the Website or purchases made from us shall be governed by, and construed in accordance with, the laws of the State of Colorado, USA, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Colorado.

7. Changes to Terms

  • We reserve the right to update or modify these Terms at any time. Any changes will be posted directly to this page with an updated “Last Updated” date. Continued use of the website following changes constitutes acceptance of the new Terms.
